This presentation is an overview of the various mechanisms for obtaining information and evidence beyond the traditional discovery tools of written discovery and depositions available in civil litigation. The presentation will discuss different types of cases common to civil defense and the many different resources available to obtain information in those cases. It will go over best practices for developing investigation checklists that new (and experienced) lawyers can use to guide them in their investigation of a case. Examples include:
Locating and obtaining records through the internet, public records, written requests, and/or subpoenas, such as public background records; insurance records; medical records; employment records; education records; social media; driving records; court records; building records; weather records; etc.
Site visits/photos; types of surveillance
Conducting witness interviews
