Over the years a wide variety of alleged construction defects have been alleged in construction defect cases brought under CDARA. This CLE will present the results of research and analysis of the most commonly cited alleged civil and structural issues and how to best address them during the design and post construction phase. Participants will receive information regarding frequently seen HOA defect issues, how plaintiffs and defendants approach COR for various defect repairs, and suggestions to pass along to clients during construction to hopefully avoid litigation in the future. The CLE will encourage discussion of these issues and suggest strategies for defending similar actions moving forward.
