Ms. Spies and Ms. Lucero will discuss strategies and practice tips to respond to the common plaintiff strategy known as the “Reptile Theory.” In short, the Reptile Theory seeks to put jurors in the shoes of the Plaintiff, fear for their and their family’s safety, and decide cases and award damages based upon an emotional response to the Reptile Theory rather than an objective evaluation of the evidence at trial.
Ms. Spies and Ms. Lucero will talk about:
Practice tips to exclude reptile theory in motions practice;
Useful voir dire strategies to recognize and dismiss reptile inclined jurors;
Effective objections to reptile theory questions at trial; and
Curtailing reptile theory during closing argument.
