"Are you SURE you want to send that?" Lawyers and Listservs: Best Practices and Ethical Cautions
Listservs are tremendously useful resources in the legal field. They serve as valuable resources of knowledge, experience, references, and community (and sometimes a good laugh). They provide a platform for easy communication with broad groups with common needs and interests. However, they are also fertile ground for abuse and misuse, and can lead to unintended consequences. This presentation will address best practices, common mistakes, and some entertaining anecdotes on using and contributing to listservs. It will touch upon listserv etiquette and the various ways users can contribute and get the most out of an invaluable resource. Discussion will also include applicable ethics opinions, rules of professional conduct, and other legal and ethical considerations when using and contributing to listservs.

Human Factors in Premises Liability Cases
There are various disciplines that can help assess how and/or why a fall event occurs. Human factors can uniquely provide an understanding of whether a given trip/slip and fall incident can be explained by typical human behavior, which in turn is informed by a wealth of scientific studies. This presentation will discuss the visual perceptual cues, looking behavior, and avoidance responses that not only help pedestrians safely navigate their physical environment, but also aid in predicting the likelihood of a fall event. We will also address issues related to codes and warnings that are often seen in these types of cases, as well as common claims made by experts in relation to human factors.

Qualifying Language in Repair Litigation
How to use your experts when tackling improperly conceived repair recommendations. Increasingly, liability experts have begun using qualifying language within their reports, such as recommending repairs “where defects exist.” While this is a potentially acceptable repair recommendation, oftentimes, drawings or other means of clarifying where these defects should be assumed to exist are not provided, leaving the responsive experts with an information void and unclear direction on approaches to address these issues. This presentation will discuss how experts can facilitate attorneys with the means to address these issues from a technical standpoint and how attorneys use this information to help their clients.
